PickupIQ Terms of Service

Effective date: August 31, 2026

PickupIQ is a sports app for organizing games and leagues, tracking stats, and sharing highlights, operated by Abed Group LLC ("PickupIQ," "we," "our"). These Terms govern your use of the PickupIQ apps and related services (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. People under 18 may not hold accounts. They may appear in the Service only as described in Section 4 (guest roster names and game media added by adult users).

2. Your account

Keep your credentials confidential; you're responsible for activity under your account. Provide accurate information. Usernames are unique and tied to your account until you change it or delete the account.

3. Your content

You keep ownership of everything you post — game results, rosters, highlight videos, messages, photos ("User Content"). You grant Abed Group LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content within the Service and on the public web pages the Service generates when content is shared (for example, highlight share links), for the purposes of operating and improving the Service.

Showing off the app. You also allow us to feature your User Content — and your username, display name, and profile photo where they appear with it — in materials that promote PickupIQ, such as our app store listings, website, and social media. If you'd rather we didn't, email ballerappsdev@gmail.com and we'll stop using it; we'll also honor a request to pull specific content from promotional material.

The license ends when the content is deleted, except for content that remains in shared records as described in the Privacy Policy, and copies already distributed through sharing features or published in promotional material before your request. You represent that you have the rights to what you post.

4. Other people in your content — including minors

Game highlights show real people. By uploading media, you confirm that the people who appear in it participated in the game or event knowing it might be recorded and shared in PickupIQ, including in materials promoting PickupIQ, and — if anyone in the media is under 18 — that you are their parent or legal guardian or have obtained their parent's or guardian's consent, which you can show us on request. You may not upload media of people who have asked not to be recorded. Anyone who appears in a highlight may report it in-app or email us to request removal; we honor reasonable requests, and always for minors. Guest roster names work the same way: hosts may add a player's name to a game record, must remove it on that person's request, and may add a minor's name only with parental consent.

5. Community standards, moderation, and enforcement

Our Community Guidelines describe what's not allowed. You can report any profile, highlight, message, or comment in the app, and block any user. We review reports and may remove content, issue warnings, restrict features, or suspend or terminate accounts — with or without prior notice for serious violations. We apply escalating enforcement for repeat violations and immediate removal for egregious ones (illegal content, exploitation of minors, credible threats). If you believe we got it wrong, email ballerappsdev@gmail.com with the subject "Appeal" within 30 days and we'll take a second look.

6. Games happen in the real world — the risks you accept

PickupIQ is software. We do not organize, host, run, officiate, supervise, staff, inspect, or insure any game, league, practice, or event. We do not vet participants, inspect venues, verify that anyone is fit to play, or provide medical or safety personnel. Games are arranged by users, and whoever organizes a game is solely responsible for it — including safety, participant eligibility, venue permission, supervision, and any insurance.

Recreational sports carry inherent and unavoidable risks. Those risks can result in property damage, minor injury, serious injury, permanent disability, or death. They include, without limitation:

By using the Service to arrange, join, attend, or record a game, you confirm that you understand these risks, that you are voluntarily choosing to participate with that knowledge, that you are physically able to participate, and that you accept those risks. You are responsible for evaluating conditions before and during play, for stopping when conditions or your own condition become unsafe, and for maintaining your own health insurance.

To the fullest extent permitted by law, Abed Group LLC is not responsible for injuries, damages, or disputes arising out of the activities themselves or out of the conduct of participants or organizers. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, and no part of this section operates as a release of liability where applicable law does not permit one.

7. We never touch your money

The Service is free to use today. PickupIQ has no payment features: we never collect, hold, or transfer money between users. If a league or organizer charges fees, that arrangement is entirely between you and them, outside the Service — Abed Group LLC is not a party to it and has no responsibility for it.

8. Future paid features

We may offer optional paid features in the future. If we do, pricing and terms will be presented before you buy, billing will be handled by Apple or Google, and these Terms will be updated. Nothing you rely on today will be taken away without notice.

9. Third-party services

The Service runs on Google Firebase (authentication, database, storage, notifications, analytics), PostHog (analytics), RevenueCat (subscription management), and Apple/Google sign-in and push services. Your use of the Service is also subject to those providers' terms; the data each processes is described in the Privacy Policy.

10. Disclaimers; limitation of liability; indemnification

The Service is provided "as is" and "as available," without warranties of any kind. We don't promise it will be uninterrupted, error-free, or secure, or that records and stats will never be lost.

To the maximum extent permitted by law, Abed Group LLC's total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the previous 12 months or $50, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. Some jurisdictions don't allow certain limitations; these apply only to the extent permitted, and nothing here limits liability that cannot lawfully be limited.

You agree to indemnify and hold harmless Abed Group LLC and its members from claims, damages, and reasonable costs (including attorneys' fees) brought by a third party and arising out of content you post, your use of the Service, an event you organize, or your violation of these Terms or applicable law — except to the extent the claim arises from our own conduct.

11. Intellectual property

The PickupIQ app, name, logo, design, and software are owned by Abed Group LLC and protected by law. Don't copy, modify, reverse-engineer, or create derivative works except as the law expressly permits.

12. Termination

You can stop using the Service and delete your account any time (Profile → Settings → Delete Account; see the Privacy Policy for exactly what deletion does). We may suspend or terminate your access if we reasonably believe you violated these Terms or the Community Guidelines, or to protect the Service or its users.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service that we can't resolve informally will be brought exclusively in the state or federal courts located in Virginia, and you and Abed Group LLC each consent to their jurisdiction and venue. Either of us may instead bring an individual claim in small-claims court where permitted.

14. Changes

We may update these Terms. For material changes we'll give at least 14 days' notice in the app or by email; continued use after the effective date is acceptance.

15. General

Severability. If any provision of these Terms — or any part of one — is held invalid or unenforceable, that provision shall be enforced to the greatest extent permitted by law, or, if it cannot be, severed; the rest of these Terms remains in full force. No waiver. Our failure to enforce a provision is not a waiver of it. Assignment. You may not assign these Terms; we may assign them to a successor to our business. Entire agreement. These Terms, with the Privacy Policy and Community Guidelines, are the entire agreement between you and Abed Group LLC regarding the Service.
